Code Compliance Frequently Asked Questions and Answers

Does the City only respond to complaints?
No, City officials also patrol the City for code violations.

Does a fence require a fence permit?
Yes, fences require a permit prior to installation. In addition, UDO 6.09 prohibits fences greater than six feet in any side or rear yard. Fences may be located in front yards provided they do not exceed 42 inches in height and are not located more than 15 feet forward of the building line. The finished side of the fence must face outward unless the abutting property consents to having the unfinished side face him/her. Maintenance on 50 percent or less of a fence does not require a permit. Relocation of an existing fence requires a new fence permit.

Do sheds require a permit?
Yes, all sheds regardless of size require a zoning compliance certificate in order to confirm compliance with applicable zoning provisions. Additionally, sheds greater than 160 square feet require a building permit and building inspections. Other accessory structures such as play structures, gazebos and pet shelters, are regulated by zoning ordinance. How should I respond to a written notice of violation?
A written notice will outline the specific violations in question, the applicable code section prohibiting such activity and any corrective actions. In many cases, there is more than one option to correct the violation. Please read the corrective procedures carefully. In addition, a timeframe for compliance is established indicating when a re-inspection will occur. Please direct questions or comments to the inspector that issued the notice. The phone number for the inspector will be listed on the notice. The inspector will be happy to address any questions or comments you may have.

Can a deadline extension be issued?
Yes, the inspector may issue a deadline extension if (1) substantial progress has been made toward compliance, (2) weather conditions make it difficult to correct the violation or (3) a mitigating circumstance exists that warrants a deadline extension. Deadline extensions are issued at the discretion of the inspector.

What is the potential penalty for a code violation?
Most code violations are classified as a minor misdemeanor and subject to a maximum penalty of $100.00 per offense per day. A few violations are classified as fourth degree misdemeanors and subject to a maximum penalty of $250.00 and/or a maximum of 30 days in jail per day per offense.
